Warranty Duration Warranty Statement For products within the KTI warranty period that prove to be defective in workmanship or materials under normal use, KTI's sole obligation will be, at KTI's discretion, to either repair the product, or replace it with equivalent new or refurbished product. KTI does not warranty against damage due to lightning or other over-voltage conditions, abuse or physical damage inconsistent with normal and intended use. KTI's warranty does not cover damage resulting from use with other products that may be incompatible. KTI does not warrant the compatibility of different products, one with the other, nor does KTI warrant that any product is invulnerable from unauthorized or fraudulent use. Without expanding on the foregoing, the maximum liability of KTI under this warranty is limited to the purchase price of the product. KTI shall have no responsibility for damage to persons or property, cost of installation/removal, incidental or indirect damages such as loss of profit or business information or any other consequence of use of a product purchased from KTI. From time to time, equipment purchased from KTI may be covered under a warranty provided by the original equipment manufacturer, such warranty will be passed directly to the purchaser by KTI at the time of purchase; the purchaser should notify KTI of all warranty failures. The foregoing is in lieu of all other warranties expressed, implied or statutory. KTI neither assumes, nor authorizes any person to assume for it, any other obligation or liability. THE PRECEDING WARRANTIES ARE KING TECHNOLOGIES SOLE AND EXCLUSIVE WARRANTIES. KING TECHNOLOGIES HEREBY SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR ARISING BY CUSTOM OR TRADE USAGE, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. Warranty Advance Replacement KTI will ship the warranty advance replacement by the same way of the original Invoice. If customer wants it shipped any other way, the customer must pay all shipping charges. KTI will invoice the customer the full price of the item plus shipping. When KTI receives the defective item and determines it to be under valid warranty, the customer will receive a refund or a credit (whichever applies) for the full amount of the warranty advance replacement invoice. If, however, the item is found not to be under a valid KTI warranty (due to lightning, abuse, water damage, operator error, etc.), the customer will be notified and charged for the item. Advanced Replacement does not include new items purchased from KTI which are covered by the original equipment manufacturer’s warranty.
